12. Responsibility

You have sole responsibility for all User Files that you store on Filemail servers through use of the Services. You acknowledge and agree that Filemail will not be responsible for any failure of the Services to store a User File, for the deletion of a User File stored on the server, or for the corruption of or loss of any data, information or content contained in a User File.

13. Reliability

Filemail can not guarantee the availability of our service. Even though we have almost no downtime, we can not be held responsible for unavailabilty of our service.

14. Changes in TOS

Filemail reserves the right to revise its policies at any time without notice.

15. Abuse

Filemail reserves the right to charge any account an extra 1 year fee, if the account is being abused by sending out SPAM e-mails. E-mail address and IP will be banned from any further use. E-mail addresses and IP may be provided to offended parties - in cases of obvious abuse and/or cases of copyright infringement.

16. Payment 

Registered users will be charged on a monthly or yearly basis according to the interval which the user chose when registering. Permanent storage that exceeds the free tier will be charged monthly.

Privacy Policy

Your privacy is very important to us. Accordingly, we have developed this Policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information. The following outlines our privacy policy.

  • Before or at the time of collecting personal information, we will identify the purposes for which information is being collected. In general - Filemail collects as little personal information as possible - we only collect what we need. Typically, it is your Name, Email address, IP address, Payment information - and also metadata related to transferring files (recipient email addresses etc).
  • We will collect and use of personal information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes, unless we obtain the consent of the individual concerned or as required by law.
  • We will only retain personal information as long as necessary for the fulfillment of those purposes.
  • We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.
  • Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
  • We will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification.
  • We will make readily available to customers information about our policies and practices relating to the management of personal information.

Data shared with third parties

  • We use Intercom for chat/support/faq. In order to identify you as a user, your Name and Email address is shared with Intercom.
  • Payments are handled by Braintree Payments. This service collects your Name, Email Address and Payment information when registering a Filemail Account. Filemail does not have access to your creditcard information.
  • You also may give us permission to access your information in other services. You may link your Google account to Filemail, which allows us to obtain information from your Google account. The information we get from Google is your profile information and list of contacts. We store your contacts inside Filemail for the purpose of building your Address Book inside Filemail. The Address Book's goal is to simplify selecting recipients of emails you can send with Filemail. After you give Filemail the permission to access your Google data you may revoke that permission at any time using Google's account settings page ( You may also remove imported contacts at any time using the Contacts page.
